Magnit Market has waived responsibility for goods lost in UAV strikes. It is now the fifth such marketplace

Magnit Market, the marketplace of the Magnit retail chain, has exempted itself from liability for failure to fulfill obligations in the event of drone strikes and missile attacks, Verstka noticed.

The new version of the agency agreement came into force on August 1. A clause was added to the offer according to which Magnit Market bears no responsibility for the loss, shortage, damage, or spoilage of goods if they were caused by force majeure circumstances.

Such circumstances include military, combat, defensive, or counterterrorism actions (“regardless of whether war has been declared,” the territory, or the side carrying out such actions).

The marketplace is also exempt from compensation in the event of “other extraordinary and unavoidable circumstances beyond the parties’ control.”

“Such circumstances include, in particular, the use or fall of unmanned aerial vehicles, missiles, munitions, and air defense systems, shelling, explosions, sabotage, terrorist acts, the fires, flooding, collapses, access restrictions, evacuation, requisition, or destruction of property by authorized bodies caused by them, as well as other extraordinary actions and events,” the agreement says.

At the same time, “necessary and proportionate actions” by marketplace employees and emergency services involving the “relocation or destruction of goods” will not be considered a breach of obligations if done “to prevent greater damage.”

🟦Earlier, the marketplaces Wildberries, Ozon, Megamarket, and Yandex Market also changed the terms of their offers and waived responsibility in the event of attacks.
