Can You Film Police Officers? Or Will That Cause Problems? An OVD-Info Lawyer Explains

Many people feel fear and anxiety at the sight of police officers. And that is understandable. To feel more confident, it is better to calmly document what is happening: the time, the place, and the sequence of events. Later, this may help challenge unlawful actions. But can you film police officers on video? Or will that only make things worse?

An OVD-Info lawyer answers:

Yes, you may film police officers while they are performing their official duties. This is stated in the federal law “On Police” — it establishes the principles of transparency and openness. At the same time, there are important restrictions that must be taken into account. In particular, the camera must not interfere with the officer’s work, so you should not shove a phone in a police officer’s face or block their path. For that, you could be charged under Article 19.3 of the Russian Code of Administrative Offenses (failure to obey a lawful order from a police officer).

And in some cases a police officer has the right to ban filming altogether:

🟧 Restricted-access facilities. Filming is prohibited in police department buildings, on guarded premises, or in areas where counterterrorism operations are being conducted. 🟧 State secrets. You may not film officers’ actions if they are connected with protecting state secrets, special operations, or operational-search activities.

🟧 Protection of third parties’ rights. Filming is prohibited if the frame includes personal data, crime victims, or minors. 🟧 Procedural actions. If an administrative offense case is being considered or investigative actions are being carried out (for example, a search), filming is allowed only with the permission of the official in charge.

In any case, if a police officer demands that you turn off the camera, they must cite a specific law or regulation. A police officer’s simple unwillingness to appear on camera is not considered a lawful basis for a ban.

The main thing is to consider the real situation and weigh the risks. Police officers often react negatively to filming: in practice, attempts to take out a phone often lead to conflict, attempts to seize the device, or additional accusations. So if acquaintances or bystanders are nearby, you can ask them to do the filming. And if you are filming yourself, do it as calmly as possible, without sudden movements and without physically resisting officers’ demands. Another option may be an audio recording: it can be switched on relatively unobtrusively.
