Yandex Market has changed the terms of its agreement with sellers, exempting itself from liability for failure to fulfill obligations in the event of drone and missile attacks, Verstka noticed.

The new version of the agreement “for the placement of product offers” was published on July 20 and came into force the same day. The changes affected the section on force majeure circumstances. It states that the contractor (Yandex Market) “is exempt from liability for partial or complete failure to fulfill obligations” in the event of “extraordinary events,” including UAV strikes.

“Any consequences of the use, impact, سقوط, launch, or activation of weapons, military equipment, aircraft (including unmanned aerial vehicles), means of destruction, ammunition and their parts, as well as shelling and explosions and other means of destruction, the effects of blast and sound waves,” the new version of the offer says.

Among other extraordinary circumstances, it also mentions terrorist attacks, military, combat, and defensive actions, the introduction of martial law or a state of emergency, and “any other established special legal regimes.”

In addition, Yandex Market classified strikes, civil unrest, uprisings, rallies, “prohibitive acts of state bodies, including movement bans,” as well as natural disasters, as force majeure circumstances.

The previous version of the offer dated July 1 did not contain a list of extraordinary circumstances. At the same time, the old version of the document said that both parties to the agreement were exempt from liability under the contract, not just the marketplace.

In addition, the new version removed the clause according to which “the party invoking force majeure circumstances is obliged to immediately inform the other party of the occurrence of such circumstances and confirm the existence of such circumstances.” Now Yandex Market is no longer obliged to do this.
